1. Introduction and Acceptance

These Terms of Use ("Terms") govern your access to and use of the Degree Apprenticeships NZ website at www.degreeapprenticeships.nz (the "Site"), including the self-assessment tool, resource pages, and all content hosted on the Site.

The Site is operated by Mischewski Consulting (Brenden Mischewski), NZBN 9429031165013 ("we", "us", "our").

By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms should be read alongside our Privacy Statement, which explains how we handle any personal information you provide.


2. About the Site

2.1 What the Site Is

The Site provides:

  • A self-assessment and planning tool (the "Tool") that guides tertiary providers through a 13-screen wizard to assess their degree apprenticeship programme readiness and generate a structured planning report.
  • Resource pages and downloadable PDF documents about degree apprenticeships in New Zealand, authored by Brenden Mischewski and published in association with ConCOVE Tūhura.
  • General information about the degree apprenticeship model.

2.2 What the Site Is Not

This is not an accreditation, audit, funding, or certification service. The Tool is a self-assessment and planning aid only. Output from the Tool — including any scores, domain ratings, narrative commentary, and milestone plans — does not constitute:

  • a formal accreditation decision or readiness certification by any body;
  • an assessment of or decision about funding eligibility;
  • an audit conducted on behalf of NZQA, TEC, MoE, or any other agency; or
  • professional advice of any kind, including legal, regulatory, or financial advice.

You should not rely on the Tool's output as the sole basis for any institutional decision. Use of the Tool does not substitute for formal engagement with NZQA, TEC, MoE, or other relevant bodies.

2.3 Independence

The Site is an independent product operated by Mischewski Consulting. It is not affiliated with, endorsed by, or acting on behalf of the New Zealand Qualifications Authority (NZQA), the Tertiary Education Commission (TEC), or the Ministry of Education (MoE).


3. Licence and Content

3.1 Site Content — Tool and Operator Materials

Unless otherwise stated, the following materials are copyright © Mischewski Consulting 2025 and are made available under a Creative Commons Attribution 4.0 International Licence (CC BY 4.0):

  • the self-assessment tool's user interface, scoring logic, recommendation narrative, and milestone plan structure;
  • website copy and original written content authored by Brenden Mischewski for this Site.

Under CC BY 4.0 you may share and adapt these materials for any purpose, including commercially, provided you give appropriate attribution (credit to Mischewski Consulting / Brenden Mischewski, include a link to the licence, and indicate if changes were made). The full licence is available at https://creativecommons.org/licenses/by/4.0/.

3.2 Degree Apprenticeships Resource Documents

The four degree apprenticeships resource documents hosted under /resources — the Guide for Tertiary Providers, the Guide for Learners, the Guide for Employers, and the Enabling Framework — are licensed under CC BY 4.0. They were authored by Brenden Mischewski and published via ConCOVE Tūhura.

When reusing or redistributing these documents, you must include the following attribution:

3.3 ConCOVE Tūhura Brand Elements

The Site does not reproduce any logos, trademarks, photography, or design elements belonging to ConCOVE Tūhura. Nothing in these Terms or on the Site grants you any right to use ConCOVE Tūhura's brand assets. Any enquiries about use of ConCOVE Tūhura branding should be directed to ConCOVE Tūhura directly.

3.4 Your Report

The report generated by the Tool is based on information you provided. You retain ownership of the free-text reflections and descriptive content you entered. We retain a stored copy of your submission as described in our Privacy Statement, and you may request deletion of it at any time.


4. Acceptable Use

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. In particular, you must not:

  • Scrape or harvest at volume. You must not use automated scripts, bots, or crawlers to extract data from the Site in bulk or in a manner that places unreasonable load on the Site's infrastructure.
  • Reverse-engineer the Tool. You must not attempt to decompile, disassemble, or reverse-engineer the scoring logic, rule library, or any other part of the Tool beyond what is permissible under applicable law.
  • Circumvent rate limits or security controls. You must not attempt to bypass rate limiting, CAPTCHA, or any other technical measure designed to protect the Site.
  • Impersonate another person or organisation. You must not submit assessments on behalf of an institution without authority to do so, or misrepresent your identity or role.
  • Include third-party personal information without consent. When completing the wizard, you must not include personal information about identifiable individuals (such as learners, colleagues, or employers) without their knowledge and consent. Employer partner fields may be completed using anonymised descriptions.
  • Submit malicious content. You must not submit content that is unlawful, defamatory, threatening, obscene, or that contains malware, phishing attempts, or any other harmful code.
  • Misrepresent the Tool's output. You must not represent Tool output as formal accreditation, audit findings, or certification to third parties, including NZQA, TEC, MoE, employer partners, or learners.

We reserve the right to restrict or terminate your access to the Site if you breach these requirements.


5. Disclaimer

The Site and Tool are provided "as is" without any representation or warranty, express or implied. To the maximum extent permitted by New Zealand law, we disclaim all warranties including but not limited to:

  • warranties of merchantability, fitness for a particular purpose, or non-infringement;
  • warranties that the Tool's output is accurate, complete, current, or suitable for any specific institutional purpose;
  • warranties that the Site will be available continuously, free from errors, or free from viruses or other harmful components.

The Tool is a planning aid. It reflects the information you enter and applies a fixed set of criteria developed by Mischewski Consulting. It does not reflect the current views or standards of NZQA, TEC, MoE, or any other body, and its output is not binding on any such body.


6. Limitation of Liability

To the maximum extent permitted by New Zealand law, Mischewski Consulting and Brenden Mischewski will not be liable for any loss or damage — whether direct, indirect, incidental, special, consequential, or punitive — arising from:

  • your use of, or inability to use, the Site or Tool;
  • any decision made in reliance on the Tool's output;
  • any unauthorised access to or alteration of your submission data;
  • any errors, inaccuracies, or omissions in the Tool's scoring or recommendations; or
  • any interruption or cessation of the Site.

Nothing in these Terms limits or excludes any liability that cannot be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Where those Acts apply, your statutory rights are preserved.


7. Indemnity

You agree to indemnify and hold harmless Mischewski Consulting and Brenden Mischewski from and against any claims, costs, damages, losses, and expenses (including reasonable legal fees) arising from:

  • your breach of these Terms;
  • your misuse of the Tool or its output; or
  • your infringement of any third party's rights in connection with your use of the Site.

8. Third-Party Links

The Site may contain links to third-party websites (including ConCOVE Tūhura, NZQA, TEC, MoE, and other reference resources). These links are provided for your convenience only. We do not endorse or have control over those sites, and we are not responsible for their content or privacy practices.


9. Termination and Restriction of Access

We may restrict, suspend, or terminate your access to the Site or any feature of it at any time, without notice, if we believe you have breached these Terms or if we need to take the Site offline for maintenance, security, or legal reasons.

Termination of access does not affect any rights or obligations that have accrued prior to termination.


10. Governing Law

These Terms are governed by the laws of New Zealand. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the New Zealand courts.


11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the version number and effective date at the top of this page. Continued use of the Site after updated Terms are published constitutes your acceptance of the updated Terms.
